What Senator Rand Paul Gets Wrong About Vaccine Liability Laws

Senator Rand Paul gets a lot wrong about vaccine liability laws, which is a shame, as he is trying to take us back to a time of frivolous lawsuits that put several vaccine manufacturers out of business.

That’s right. Sen. Rand Paul has introduced the End the Vaccine Carveout Act in the Senate with Utah Sen. Mike Lee. The act was introduced in the House by Arizona Rep. Paul Gosar.

The End the Vaccine Carveout Act

So what does the END the Vaccine Carveout Act actually do?

It essentially upends the Vaccine Injury Compensation Program that was created by the National Childhood Vaccine Injury Act of 1986 that was cosponsored by Sen Ted Kennedy.

Instead of going through the Vaccine Injury Compensation Program, the END the Vaccine Carveout Act would remove the statute of limitations for vaccine injuries and give people an option to sue vaccine manufacturers directly, even for COVID vaccines, which were previously covered by the PREP Act.

So they could still go through Vaccine Court, but they wouldn’t have to. Believe it or not, people should know that you can sue vaccine manufacturers directly now, you just have to go through Vaccine Court first.

But isn’t it a good thing to be able to sue someone if they did something wrong?

Well, usually, sure!

Going through a no-fault program, like the VICP, is typically thought to be less challenging than suing a vaccine manufacturer directly though.

The other very big problem sadly, is that anti-vaccine influencers have gotten people thinking that anything and everything that happens to them in the days, weeks, months, and years after they get a vaccine is a vaccine injury.

And that will lead to the same types of frivolous vaccine lawsuits that we saw in the early and mid 1980s. Frivolous vaccine lawsuits that caused many vaccine manufacturers to stop making vaccines.

Worried not only about multimillion-dollar settlements, but also even the legal costs of defending themselves successfully, several companies simply stopped making vaccine.”

Which is probably the point, right?

This is just another part of RFK Jr.’s anti-vaccine agenda to get fewer kids vaccinated and protected.

But know, whether it is coming from Rand Paul, Del Bigtree and Aaron Siri and their plan to try to add 300 vaccine injuries to the Vaccine Injury Table, or Mark Gorton and his MAHA Institute, RFK Jr.’s anti-vaccine agenda will not succeed.

We will not go back to an age when children needlessly suffered and died from measles, polio, diphtheria, pertussis, epiglottitis, Hib meningitis, mumps, pneumococcal meningitis, and other vaccine preventable diseases.
