It seems that some folks think that the Department of Health and Human Services hasn’t been complying with federal vaccine safety mandates for 30 years.

Did the US Government Lose a Landmark Vaccine Lawsuit?
While anti-vaccine folks are pushing this lawsuit victory (?) to make folks think that HHS has done absolutely nothing to promote vaccine safety in the last 30 years, that is obviously nonsense.
The lawsuit was actually just about the reporting requirements of paragraph (c) of section 2127 of the National Childhood Vaccine Injury Act of 1986.
It should be clear that the HHS has done plenty to promote vaccine safety though.
Even if no formal reports were filed, the HHS secretary did report to and appear before Congress. Come to think of it, they even sent some reports to Congress.
And the Health and Medicine Division (HMD) division (previously known as the Institute of Medicine (IOM) of the National Academies of Sciences, Engineering, and Medicine has published a number of vaccine safety reviews and reports under commission of HRSA, an agency of HHS.
Where do folks think that all of those IOM vaccine safety reports and reviews come from? Were they sent to Congress?
And also consider that:
- the National Vaccine Advisory Committee (NVAC), established in 1987, has had regular meetings and published regular reports about vaccine safety
- a number of other vaccine safety oversight advisory committees and government groups were established, including the Advisory Commission on Childhood Vaccines, the Advisory Committee on Immunization Practices (ACIP), the Microbiology and Infectious Diseases Review Advisory Committee (MIDRAC) of NIAID, and the Vaccines and Related Biological Products Advisory Committee, with the Vaccine Interagency Group of the National Vaccine Program Office providing overall coordination. They all report to the Secretary of HHS.
- the Vaccine Adverse Events Reporting System (VAERS) and Vaccine Safety Datalink were established in 1990, but it is important to keep in mind that VAERS was created from a merger of the CDC Monitoring System for Adverse Events Following Immunization (MSAEFI) and the vaccine reports contained in the FDA Spontaneous Reporting System (SRS) programs. It’s not like we just start following adverse events following immunization in 1990.
- a Task Force on Safer Childhood Vaccines was established and completed a report, “identifying key issues and enhancing collaboration on behalf of vaccine safety” in 1996. Did someone forget to send it to Congress?
- the Salk inactivated polio vaccine (IPV) replaced the oral polio vaccine (OPV) in 1996 because of a small risk of vaccine-associated paralytic poliomyelitis (VAPP), beginning with a sequential IPV-OPV vaccine schedule and then going to an all IPV schedule in 2000
- the DTaP vaccine, which is supposed to have fewer side effects than DTP is licensed, and replaces DTP for all required doses by 1997, although DTP is never actually shown to have caused seizures or brain damage
- RotaShield, the first rotavirus vaccine is licensed in 1998 but is soon withdrawn from the market in 1999 after it is associated with an increased risk of intussusception, a form of bowel obstruction
- the Clinical Immunization Safety Assessment (CISA) Project was established in 2001
- a new National Vaccine Plan was established in 2010, with the goal to develop new and improved vaccines, enhance the vaccine safety system, support communications to enhance informed vaccine decision-making, ensure a stable supply of, access to, & better use of recommended vaccines in the U.S., and increase global prevention of death & disease through safe & effective vaccination. Was the plan sent to Congress?
- vaccine recalls have occasionally been issued
- a White Paper on the U.S. Vaccine Safety System was published in 2011
- a report on Safety of Vaccines Used for Routine Immunization
in the United States was published in 2014 - a report on Overcoming Barriers and Identifying Opportunities for Developing Maternal Immunizations was published in 2016
Most importantly, new vaccines have been approved that protect our kids against many more now vaccine-preventable diseases.
HHS Settles Lawsuit Over Vaccine Safety Reporting
But wait, did the HHS even lose the lawsuit?
They actually didn’t.
They did settle a lawsuit though, a lawsuit which was then dismissed.
So like the CDC whistleblower movie that didn’t include a whistleblower, anti-vaccine folks think that they have a smoking gun about vaccine safety reports, except that it is very obvious that all kinds of reports about vaccine safety have been done over the years.
Vaccines are still safe. And they are still necessary.
What to Know About the HHS Vaccine Lawsuit
Although it does seem like HHS didn’t file the required formal reports and keep to the strict letter of the National Childhood Vaccine Injury Act of 1986, there is abundant evidence that they have actually done all of the work required to make sure that our vaccines are safe.

Wow… you seriously messed up. I understand this is just your opinion with some quick facts from the closest CDC website you could find, but I hope you knew when you made this article you would practically be throwing a rock at a wasp nest from 2 feet away. I aplaud your patriotic exercise of free speech, well done, but here comes the whiplash. HHS failed and that sucks and they are now millions of dollars in debt.They failed at the one job they were supposed to do for 32 years. We trusted them. Even if there are studies that say vaccines are safe and effective and we should shoot up 7 of them in one sitting, we trusted the HHS. Also don’t try to label everyone as “anti-vaxxers” as most of us are not. Anti vaxxers are completely against even the thought of vaccines. I for one would love a disease cure all medical precedure with no side effects. Safe vaccines are an amazing idea, but even the fact that the HHS didn’t do any safety studies (or if they did and they’re hiding it from us) makes me unsure. I don’t expect you to instantley say, “wow you’ve changed my mind.” as that is the most rare thing on earth, but I hope you have at least listened to someone else’s opinion.
Wait a second I confused Monsanto’s multi-million dollar lawsuit with this one, sorry. They are however going to be in debt if this lawsuit goes any further.

Is that oregonians for medical freedom? Thanks. The were not complying with reporting the saftey to the public that’s a big deal. I think this is even worse, they actually do have the reports to provide to congress, and aren’t providing them to the public as stipulated.
What is shocking is that big pharma point blank refuse to modernise their method of making vaccines. There are modern techniques that would mean aluminium or mercury would not be required as adjuvant… no neurotoxins in baby vaccines… wouldn’t that be a huge step forward.. but no because they say their vaccines are proven by data and they aren’t prepared t start from

If you own an animal then tell your vet you don’t want to vaccinate them and see what you get. Wow they sell “safer vaccines”. That just Fin scary in and of itself. I had animals of all breeds dying at around 10 years of age and brought them to vet regularly until I was vaccine injured. That’s when I decided to do my own little expirement. The last animal standing was not given any vaccinations etc from that point on. He lived to 18 and he went outside regularly (cat). Go figure!!
I’d say that this is a classic example of regulatory capture but this sham goes much further than that. This industry actually got litigation immunity! In exchange they agreed to submit to regulatory agency oversight, but, as usual, that agency ends up being their biggest apologist, protector, promoter, and cheerleader. It is to laugh.

I literally just read it and it says the current vaccine schedule is safe. “In this most comprehensive examination of the immunization schedule to date, the IOM committee uncovered no evidence of major safety concerns associated with adherence to the childhood immunization schedule.” Maybe you should have read the article before making false statements about what the article said. ” The committee’s review did not reveal an evidence base suggesting that the U.S. childhood immunization schedule is linked to autoimmune diseases, asthma, hypersensitivity, seizures, child developmental disorders, learning or developmental disorders, or attention deficit or disruptive disorders”. The massive amounts of antibiotics in vaccines make them potentially unsafe for children and adults. These antibiotics have likely caused devastating demyelination in a small number (?) of vaccine recipients. Some data also suggest vaccines cause a plethora of autoimmune diseases, including rheumatoid arthritis, although to my knowledge, a study has never been done to confirm or refute this hypothesis.
It is not the miniscule amounts of mercury or aluminum that should have us worried. It is the active ingredients in vaccines which are intended to short-circuit beneficial biological mechanisms, which need to be investigated for safety.
I am not an anti vaxxer, but i am cautious and informed about whati inject into my body. Apologist pieces like this one do little too assuage my concerns; in fact my concerns are amplified, because with religious fervor the writer defends his beloved government organizations and pharmaceutical companies, which have shown themselves to be unethical in many matters.
I understand the concept of herd immunity and agree that it confers a benefit on society. I don’t want to ignore or minimize that fact. In 1986, Congress charged Health and Human Services (HHS) with the primary responsibility of ensuring vaccine safety after removing product liability from vaccine manufacturers as part of the National Childhood Vaccine Injury Compensation Act. This means vaccine manufacturers cannot be sued regardless of how toxic their product is, regardless of how little safety testing they have done and regardless of if they knew their vaccines cause harm and sold them anyway. As part of the 1986 Act, HHS is required to create a task force and submit bi-annual reports to Congress detailing actions taken to ensure vaccine safety. This stipulated order shows that HHS has not acted in its duties regarding vaccine safety, forcing 78 million American children into a vaccine program with no safety provisions. A vaccine is an immune-modulator. Therefore it is bound to have side effects. If the medical community would just embrace this then they could find safer ways to vaccinate people and not lose the trust of the masses.
